Welcome to Techta Services LLP! These Terms and Conditions ("Terms") govern your use of
our website and services, including online and offline courses, offered by Techta Services
LLP ("Techta," "we," "us," or "our"). By accessing or using our platform, you agree to be
bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Use of Services
1.1 Eligibility
You must be at least 18 years old to use our services. If you are under 18, you
may use our services only with the involvement of a parent or guardian.
1.2 Account Registration
To access certain features, you may need to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for
all activities that occur under your account.
1.3 Acceptable Use
You agree to use our platform only for lawful purposes and in
compliance with all applicable laws and regulations. You may not:
- a) Violate any intellectual property rights.
- b) Use our platform to distribute spam or harmful content.
- c) Interfere with the operation of our platform.
2. Course Enrollment and Payment
2.1 Enrollment Process
- a) To enroll in a course, you must complete the registration process on our platform
and provide accurate and up-to-date information.
- b) Once your registration is complete, you will receive a confirmation email with details
about the course, including the start date, schedule, and access information.
- c) Enrollment is subject to availability, and we reserve the right to reject any
enrollment request at our discretion.
- d) Upon successful enrolment into our Course, you get a license from us to view/access
it, depending on the specific program via the Platform, through live streamed classes
on third party applications and/or physically at our Offline Centres and for no other
use. You are hereby expressly barred from transferring or reselling Courses in any
way.
- e) The Course Material provided by Techta Services LLP is licensed to you, not sold. This
license grants you a limited, non-exclusive, non-transferable right to access and view
the Course Material and associated content for which you have paid the required
fees. You may use the Course Material solely for your personal, non-commercial,
educational purposes through our services, and in accordance with these Terms, as
well as any conditions or restrictions associated with a particular course or feature.
You are expressly prohibited from transferring or reselling the Course Material in any
manner, including sharing your account information with others or downloading the
Course Material to distribute it through third-party platforms. Additionally, you may
not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend,
modify, adapt, edit, create derivative works of, sublicense, or otherwise use the
Course Material without prior explicit permission in a written agreement signed by
an authorized representative of Techta Services LLP. Any unauthorized use of the
Course Material is strictly prohibited and may result in legal action.
- f) You may access the Course Material exclusively through our Platform, whether the Course is
delivered remotely or in person. We reserve the right to revoke your license to access and
use the Course Material at any time if we choose to, or are required to, disable access to a
Course for legal or policy reasons. For example, this may occur if the Course you enrolled in
becomes subject to a copyright complaint or is found to violate our Terms and policies.
Please note that lifetime access does not apply to any add-on features or services associated
with the Course.
- g) All support, both internal and external, provided by Techta will be available for a
period of one year from the date of enrollment. During this time, you will have
access to our live courses, which include lectures, discussions, assignments, and
interactive sessions with our instructors. These sessions allow you to ask questions,
seek clarification, and learn alongside other participants. Additionally, you will enjoy
access to premium features and resources included in your enrolled program.
2.2 Fee Payment
- a) Fees for courses will be discussed and confirmed by academic counsellors at the time
of enquiry. You will get an email with all the details of the course enrolled. The
course fee is subject to changes as per discretion of Techta.
- b) Payment must be made in full at the time of enrollment unless otherwise specified
at the time of enrollment.
- c) We accept the following payment methods: cash, cards payments (All credit and
debit card payments and internet banking are processed through third party
payment aggregators), UPI and internet banking. All payments are required to be
done to the bank account of Techta only.
- d) Partial payments or installment options may be available for certain courses. These
options, if offered, will be clearly mentioned during the enrollment process.
- e) We use third-party payment aggregators for processing of online payments. Third
Party Service Providers may also charge you fees to use or access their services and
may require your Personal Information (as defined in the Privacy Policy) to complete
any transaction on the Platform and/or at our Offline Centres. Further, to facilitate
completion of your payments to us through the Platform or avail the payment options
provided to you, you may be redirected to an external website operated by the Third
Party Service Provider. We cannot and do not (i) guarantee the adequacy of the
privacy and security practices employed by or the content and media provided by the
Third-Party Service Provider or its respective websites; or (ii) control collection or use
of your Personal Information (as defined in the Privacy Policy) by such Third-Party
Service Provider. Hence, prior to using any services offered by a Third-Party Service
Provider, we suggest that you read their terms and conditions, privacy policy and
other policies, that may apply, to understand their terms of usage and to understand
how your Personal Information (as defined in the Privacy Policy) is being processed.
Techta is not affiliated to any Third-Party Service Provider and neither Techta nor any
of the Third-Party Service Provider are agents or employees of the other.
- f) You agree that you are solely responsible for all charges that occur through such Third
Party Service Providers and acknowledge and agree to indemnify, defend, and hold
harmless Techta, its affiliates, their respective officers, directors, employees, and
agents from any loss arising out of or related to the use of the Platform or any
purchases made through the Platform. This obligation will survive your use of our
Services and termination of your Agreement with us. For purposes of these Terms,
"Loss" means all losses, liabilities, damages, awards, settlements, claims, suits,
proceedings, costs, and expenses (including reasonable legal fees and disbursements
and costs of investigation, litigation, settlement, judgment, interest, and penalties).
Techta shall not be liable to you for any claims arising out of any act or omission on
the part of the Third-Party Service Provider(s) including, but not limited to, any lost,
stolen, or incorrectly processed payments. Techta expressly disclaims any
responsibility and liability for all services provided by the Third-Party Service
Provider(s).
2.3 Late or Failed Payments
- a) If a payment fails or is delayed, we reserve the right to suspend access to course
materials until the issue is resolved.
- b) In the case of installment payments, failure to make timely payments may result in
cancellation of enrollment without refund.
2.4 Refund Policy
All courses purchased with Techta are Non-Refundable and Non-Transferable. Techta
shall not be obligated to entertain or accept any refund requests for any kind of
payments including, but not limited to, payments against registration, fee instalment or
full payments of course fee.
3. Placement Assistance
3.1 Placement assistance is an additional support service designed to help students
transition into the workforce. This service is available only for select courses, as specified
on our website. To qualify for placement assistance, students must successfully
complete the course by meeting all requirements, including assignments, projects, and
assessments. Additionally, students must meet the minimum performance criteria
outlined for the course and actively participate in preparatory activities, such as resume
building workshops and mock interviews conducted by Techta.
3.2 The placement assistance program includes personalized guidance for creating and
optimizing professional resumes, mock interviews to simulate real-world scenarios, and
sharing relevant job opportunities. We also coordinate interview schedules with
partnering organizations or companies. This service is available for up to one year from
the date of enrollment. After this period, placement assistance will no longer be
provided, regardless of the student's course completion status.
3.3 To maximize the effectiveness of the program, students are expected to actively engage
in all preparatory activities and interview sessions. Students must also accept job offers
facilitated through the placement program unless a valid reason for rejection is provided
in writing to Techta. Failure to accept a reasonable job offer without valid justification
may result in the discontinuation of placement assistance.
3.4 It is important to note that Techta does not guarantee job placement. The outcome
depends on the student's skills, performance, and prevailing market conditions.
Placement assistance is available only to students who meet all eligibility criteria and
fulfill their obligations. Techta assumes no liability for the decisions or actions of
potential employers.
4. Intellectual Property
4.1 Ownership
All course materials, including videos, text, graphics, our logos, API,
database, codes and other content, are the property of Techta or its licensors. You are
granted a limited, non-exclusive, non-transferable license to access and use the course
materials for personal, non-commercial purposes.
4.2 Restrictions
All the content, logos, texts, graphics, API, database, courses, generated by
Techta, through its employees or other service providers will remain the right of Techta.
Users will be given only a limited, non-exclusive, non-transferable license to access it.
5. Limitation of Liability
While we strive to provide high-quality educational content, we do not guarantee specific
outcomes or results from using our services. Our services are provided "as is" and "as
available." We disclaim all warranties, express or implied, to the fullest extent permitted by
law. To the maximum extent permitted by law, our liability for any claims arising from your
use of our services is limited to the amount you paid for the course, excluding taxes.
6. Governing Law and Dispute Resolution
These Terms are governed by the laws of Republic of India. Any disputes will be resolved
through arbitration by a sole arbitrator, appointed by mutual consent. The venue and
seating of arbitration will be in Trivandrum and the awards rendered by the sole arbitrator
shall be final and binding.
7. Force Majeure
Techta Services LLP shall not be held liable for any failure or delay in performing its
obligations under these Terms due to events beyond its reasonable control. In the event of a
force majeure, we will make reasonable efforts to resume services as soon as possible.
However, we are not obligated to provide refunds or compensation for any disruptions
caused by such events.
8. Changes to Terms
We may update these Terms from time to time. Any changes will be posted on our website,
and your continued use of our services constitutes acceptance of the updated Terms.
